The collection of your personal data is carried out with the main purpose of being able to offer and provide you with the services offered on this website.

The only case in which we transfer your contact details to the association GREC Mallorca (Grup d'Educadors de Carrer i Treball amb Menors) is when you book The Humane Room at the MarSenses Natura Olea Hotel. In this case, the sole purpose of the transfer is so that the Association can thank you directly for the contribution of the net amount (excluding taxes) of your booking and to ensure that Mar Senses S.L. has received this amount.
MAR SENSES informs you that it has implemented the necessary technical and organizational security measures to guarantee the security of your personal data and prevent its alteration, loss, processing and/or unauthorized access, in accordance with the provisions of Organic Law 3/2018, of 5 December, on the Protection of Personal Data and the guarantee of digital rights.
Applicable legislation and jurisdiction
This Legal Notice is governed in each and every one of its aspects by Spanish law, and the Courts and Tribunals of Palma shall be competent to resolve any conflict arising from or related to the use of this portal.

1.- Purpose – For what purposes do we process your data?
MAR SENSES informs the User of the existence of a personal data processing activity (called “WEB USERS”) created with the data obtained on the website, under its responsibility.
This processing has been created for the purpose of providing information about the services offered through the Portal, as well as attending to and managing queries made by users through this channel.
Data retention periods:
- In the case of queries: Once the query has been answered, during the current year.
- In the case of contracting services: For the duration of the contractual relationship.
2.- Legitimation – What is the legal basis for processing your data?
The legal basis for the processing of users' personal data is the consent of the data subject.
The prospective offer of services is also based on the consent requested from the user, and the withdrawal of such consent does not condition the execution of other purposes.

Insurance services: By contracting our services, you accept the transfer of your personal data to FLEXMYROOM INSURETECH, S.L., domiciled in Benidorm (03503 - Alicante), Calle Gerona, 13, Local CA 18, CIF: B42687616, for the sole purpose of enabling you to benefit from the insurance services offered. This entity will cancel your personal data once the service has ended and the legally established deadlines have been met. You may exercise your rights at: datos@flexmyroom.com.
The Humane Room booking: When booking The Humane Room at MarSenses Natura Olea Hotel, you accept the transfer of your personal data to GREC Mallorca (Grup d'Educadors de Carrer i Treball amb Menors) for the sole purpose of enabling the Association to thank you directly for your contribution and verify receipt of the corresponding amount. You may exercise your rights at: protecciodades@grecmallorca.org.

- The forms you complete in order to sign up as an agency in our partnership programme.
- Information provided during the programme development.
All data is provided either directly by you or by third parties who process requests on your behalf, for example, the travel agency that has booked your stay.
The categories of data we typically process include:
- Identifying data.
- Contact details, postal and email addresses.
- Financial and transaction data.
- Data related to and generated by the booking.
For what purposes will we process your data?
Your data will be processed in order to manage the partnership programme, the bookings made with us and to comply with our legal obligations.
Who can we share your data with?
We will only communicate your data under legal obligation or when necessary for the provision of the requested services.
For example, if a booking includes ancillary services provided by third-party suppliers, or if an availability request affects such services, the personal data necessary to process the booking or request will be communicated to the relevant suppliers solely for that purpose.
Under current legislation on security protection, we are obliged to communicate information about your stay to national law enforcement authorities.
Legal basis for processing
The legal basis for processing your data is the execution of the partnership agreement and bookings for the clients of the partner agency, as well as compliance with our legal obligations, in particular:
- Law 8/2012 of 19 July, on Tourism in the Balearic Islands and other applicable tourism regulations.
- Organic Law 4/2015 of 30 March, on Citizens’ Security and its implementing regulations.
- Applicable accounting and tax regulations.
How long will we retain your data?
Your data will be retained for the duration of your relationship with us and, in any case, for the time periods established by applicable legal provisions and the time necessary to address potential liabilities arising from processing.
We will delete your data when it is no longer necessary or relevant for the purposes for which it was collected.
Regarding bookings made by your agency’s clients, we inform you that, in accordance with applicable regulations, we retain traveller registration records for three years from the date of the last registration sheet included therein.
What are your rights?
You have the right to obtain confirmation as to whether or not we are processing your personal data and, if so, to access it.
You may request the rectification of inaccurate data or the completion of incomplete data, as well as request deletion when, among other reasons, the data is no longer necessary for the purposes for which it was collected.

Conditions of Reservation
This document aims to inform you about the general conditions applicable to the booking process through the MAR SENSES website (hereinafter, “the Website”).
On the Website, you will find information about room availability, rates, and services offered by Mar Senses S.L.'s hotels.
Reservations made through the Website are formalized directly between the user and the hotel's operating company chosen by the user. Mar Senses, S.L., as the administrator of the online reservation center, is not part of the legal relationship established between the user and the hotel.
Making reservations implies the full and unconditional acceptance of the Legal Notice, Privacy Policy, and these General Conditions in their latest version. We recommend reading these conditions before making your reservation, as the Website reserves the right to modify them at any time.
Legal Regulation
These General Conditions are subject to the provisions of:
- Law 7/1998, of April 13, on General Conditions of Contracting.
- Royal Legislative Decree 1/2007, of November 16, approving the revised text of the General Law for the Defense of Consumers and Users and other complementary laws.
- Law 34/2002, of July 11, on Services of the Information Society and Electronic Commerce.
- Applicable tourism regulations.
- Subsidiarily, the Civil Code and the Commercial Code.
Clauses
1) Declarations
- a) The user declares to be of legal age and to have full legal capacity to formalize the reservation, stating that they understand and accept all the conditions on the Website.
- b) The data provided when formalizing the reservation is true, complete, and accurate.
- c) Confirmation of the requested reservation, especially the indicated dates, number of rooms, number of persons, accommodation, and chosen board basis.
- d) According to Mar Senses S.L.'s internal regulations, pets not explicitly authorized by current legislation or the company are not allowed.
2) Website Access
The user is responsible for accessing this Website and for the proper use of its contents and services.
3) Contracting of Products and Services through the Website
- 3.1. Reservations include the detailed services according to the conditions stipulated on the reservation page.
- 3.2. Accommodation providers are responsible for complying with obligations arising from current regulations and the specific terms and conditions of sale of each contracted product or service.
- 3.3. These General Conditions must be accepted before formalizing the reservation. The contract may be validly formalized in any of the languages available on the Website.
4) Reservation Formalization Process
- 1. Availability search: selection of dates, number of people, and rooms.
- 2. Choice of board basis, room type, and rate.
- 3. Reservation summary, collection of customer data, and, where applicable, payment via virtual POS.
- 4. Reservation confirmation: once completed, emails and system logs will be archived. The customer will receive confirmation by email, including a booking reference number (locator).
5) Price and Payment
- 5.1. The conditions, price, and payment terms are expressly determined in the rate conditions displayed at the time of booking.
- 5.2. Promotions and offers are valid only while they remain accessible on the Website.
- 5.3. Prices indicated are Public Sale Prices and include VAT. All transactions are processed in EUROS, regardless of the customer’s origin.
- 5.4. Reservations will be definitively confirmed 72 hours after the first confirmation via the Website and email. This period ensures there are no availability or pricing errors. If no discrepancies are detected, the reservation will be considered confirmed. If discrepancies arise, the reservation may be canceled and the user will be contacted.
6) Cancellation, Modification and No-Shows
- 6.1. Conditions will depend on the rate selected by the customer.
- 6.2. All applicable charges will be made to the credit card provided during the reservation process. By completing the reservation, you expressly authorize these charges to cover applicable penalties for cancellations or no-shows.
7) Notifications
All notifications, requirements, requests, and communications between the parties related to these General Conditions must be made by email or through the contact form available on the Website.
8) Nullity of Clauses
If one or more clauses of these General Conditions are declared null or ineffective, this shall affect only the specific provision concerned, while the remaining clauses shall remain fully valid.
Any modification or cancellation of a reservation must be managed through the Website using the link provided in the confirmation email or must receive written confirmation from the hotel to be valid.
9) Acceptance
The request and formalization of a reservation necessarily imply the express acceptance of these General Conditions, considered an integral part of the reservation and supplemented by the applicable rate conditions and specific legislation.
10) Applicable Law and Jurisdiction
This contract shall be governed by Spanish law. For any dispute regarding its validity, execution, compliance, or termination, the parties expressly submit to the jurisdiction of the Courts and Tribunals of Palma (Mallorca, Spain).
